Family and Domestic Violence Leave is changing

Medium and large businesses (15 or more employees) make the change from unpaid to paid leave on 1st February 2023.
Small businesses (less than 15 employees) have been given a 6 month extension to 1st August 2023.

Under the new provisions, family and domestic violence means violent, threatening or other abusive behaviour by an employee’s close relative, a current or former intimate partner, or a member of their household that both:
-seeks to coerce or control the employee
-causes them harm or fear.

Don’t have time for long drawn out explanations? Here is the skinny:
– 10 days (not pro-rata) paid leave for all employees – full time, part time AND casual (casuals paid as per rostered time)
– Does not accrue – full 10 days available at start of employment or transition to new system
– Does not rollover – allocation renews on employment anniversary each year
– Does not get processed as family and domestic violence leave on payslip, so payslip looks ‘normal’
– Evidence has to convince a reasonable person that the employee took the leave to deal with the impact of family and domestic violence.
