Christmas and New Year public holidays 2022

As you process leave requests and prepare Christmas holiday wage payments, make sure you’ve got the public holidays sorted.

You need to pay normal hours for all full and part time staff for public holidays that fall on their normal working days. Public holidays are paid before leave is processed. If employees are taking unpaid leave, public holidays will also be unpaid.

What does this look like? For example, if your NSW team are working up to and including Friday 23rd December and returning to work on Monday 9th January 2023.

A full time employee who works 9-5 Monday-Friday:
Public holidays on Monday 26th & Tuesday 27th December.
Annual leave days for Wednesday 28th, Thursday 29th and Friday 30th December.
Monday 2nd January is a public holiday.
Tuesday 3rd, Wednesday 4th, Thursday 5th and Friday 6th January will be annual leave days.
Your employee will be paid for 3 public holidays and 7 annual leave days.

A part time employee who works 10am – 2pm Monday to Friday:
paid the same way as the full time employee – 3 public holidays @4hrs and 7 annual leave days @4hrs.

A part time employee who works 9-5 Tuesday to Thursday:
Public holiday on Tuesday 27th December. Annual leave days for Wednesday 28th and Thursday 29th December.
Tuesday 3rd, Wednesday 4th and Thursday 5th January will be annual leave days.
1 public holiday and 5 annual leave days.

A full time or partime employee who has no available annual leave will not be paid at all.
